1. Introduction and Acceptance of Terms

1.1. This User Agreement ("Agreement") governs access to and use of the NakedPoly website ("Site", "Platform").

1.2. By registering on the Site or making a purchase or sale, you unconditionally accept the terms of this Agreement. If you do not agree with any provision, stop using the Site immediately.

2. Eligibility (Age Restriction)

2.1. NakedPoly is a platform for 18+ content. You confirm that you are at least 18 years old (or the age of majority in your country of residence).

2.2. The Platform prohibits use by minors. Violation of this clause is grounds for immediate permanent account suspension.

3. Platform Status

3.1. NakedPoly is a technology intermediary (marketplace). We provide infrastructure for listing, purchasing, and selling digital content.

3.2. We are not the creators of user-uploaded content and are not responsible for its substance, accuracy, quality, or compliance with any standards, unless otherwise expressly stated in the quality policy.

4. Creator (Merchant) Responsibilities

4.1. Rights warranties: By uploading content, the Creator warrants that they hold all necessary exclusive rights, including intellectual property rights, likeness rights (model releases), and related materials.

4.2. Prohibited content: The following uploads are strictly prohibited:

• Materials that violate the law (child sexual abuse material, content involving minors, content promoting violence, non-consensual content, etc.).
• Materials that infringe third-party rights (plagiarism, unauthorized use of others' intellectual property).
• Malware, viruses, scripts.

4.3. Liability: If third-party claims arise, the Creator must resolve them independently and indemnify the Platform for any losses (including legal fees and penalties) caused by publishing such content.

5. Licensing and Content Rights

5.1. When purchasing an item on NakedPoly, the Buyer acquires a non-exclusive license to use it as described in the listing (personal or commercial license).

5.2. The Buyer does not acquire copyright in the model and may not distribute model files, resell them, or publish them publicly.

6. Payments and Fees

6.1. All financial transactions are processed through third-party payment gateways (e.g., NOWPayments).

6.2. The Platform retains a commission on each sale as specified in the "Pricing" section.

6.3. Payouts are sent to wallets specified by Creators. The Platform is not liable for lost funds resulting from incorrect payment details provided by the Creator or issues on the blockchain network.

7. Disclaimer

7.1.The Site is provided "as is". The Platform does not guarantee uninterrupted operation, error-free service, or that products will meet Buyer expectations.

7.2.We are not liable for damage to the Buyer's software or hardware resulting from use of downloaded files. File safety verification is the responsibility of both the Creator and the Buyer.

8. Intellectual Property (DMCA)

8.1. NakedPoly respects copyright. If you believe any content infringes your rights, you may submit a DMCA Notice.

8.2. We reserve the right to immediately remove content subject to a valid complaint and suspend the infringing account without prior notice.

9. Account Suspension

9.1. The Platform reserves the right to unilaterally suspend any user who violates this Agreement, without explanation and without compensation for blocked balance funds (if obtained unlawfully or through rule violations).

10. Indemnification

10.1. The User agrees to indemnify and hold harmless NakedPoly, its employees, owners, and partners from any claims, demands, or lawsuits arising from the User's breach of this Agreement or violation of applicable law.

11. Final Provisions

11.1. The Platform may amend this Agreement. Continued use of the Site after changes constitutes acceptance of the new version.

11.2. All disputes shall be resolved through negotiation or in accordance with applicable law.
